1. Scope

These General Terms and Conditions apply to the use of the mobile app FeedFocus (hereinafter "App") and the associated website feedfocus.app, operated by:

(hereinafter "Provider")

By registering (signing in with Google or with Apple) and using the App, the user accepts these Terms. The App is aimed at consumers and entrepreneurs within the meaning of §§ 13, 14 BGB (German Civil Code).

2. Description of services

FeedFocus is an iOS app that offers the following functions:

The Provider owes the provision of the App in its respective version. There is no entitlement to specific functions or continuous availability. The Provider reserves the right to change, expand or discontinue functions.

3. Usage license and restrictions

The Provider grants the user a non-exclusive, non-transferable, revocable right to use the App for private and commercial purposes.

The user undertakes:

3.1 YouTube Terms of Service

FeedFocus uses YouTube API Services. By using FeedFocus, the user agrees to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms). The Google Privacy Policy applies in addition (https://policies.google.com/privacy).

4. Subscriptions and payment terms

4.1 Subscription tiers

The App offers the following tiers:

The quotas stated here apply at the launch of the service. Changes are governed by Section 7.2.

Measurement of AI summaries: The quota is measured by video length. One unit is used for each started 60 minutes of video runtime. The runtime reported by YouTube is decisive. If the duration cannot be retrieved from YouTube in an individual case, the duration transmitted by the app, previously obtained from YouTube, is used; if this is not available either, one unit is consumed. No new summaries are created for videos with a runtime of more than 4 hours, including within briefings; a single video therefore uses no more than 4 units. In automatic briefings and digests, a video whose duration cannot be retrieved is processed; the 4-hour limit cannot be checked in that case. Existing summaries of such videos remain available. Consumption is counted against the quota of the respective subscription tier; a notice is shown once the quota is reached. Unused quotas expire at the end of the respective period and are not carried over.

4.2 Free trial period

New customers can try the PRO tier free of charge once for 7 days. The trial period is actively started via Apple In-App Purchase and, after expiry, automatically converts into the paid subscription selected at the start, unless it is cancelled at least 24 hours before expiry via the iOS settings. During the trial period, up to 7 audio productions (audio digests and briefings combined) are included; otherwise the range of functions corresponds to the PRO tier. If the trial period is cancelled, the App is available in the FREE tier after its expiry.

4.3 Payment processing

Payment is processed exclusively via Apple In-App Purchase (StoreKit). The Provider has no access to the user's payment data. Apple's payment terms apply additionally.

4.4 Automatic renewal

Subscriptions renew automatically for the respective billing period unless cancelled at least 24 hours before expiry via the iOS settings.

5. Right of withdrawal

For digital content: the right of withdrawal expires if the user has expressly agreed that performance begins before the expiry of the withdrawal period and has confirmed their knowledge that they thereby lose their right of withdrawal (§ 356 (5) BGB).

For subscriptions: cancellations of Apple in-app subscriptions are governed by Apple's policies. Apple grants refunds in certain cases. The Provider cannot make refunds for purchases processed via Apple.

6. Liability

6.1 Limitation of liability

The Provider is liable without limitation for damage arising from injury to life, body or health, as well as for damage caused intentionally or through gross negligence.

Otherwise, the Provider is liable only for the breach of essential contractual obligations (cardinal obligations) and only limited to the foreseeable damage typical for the contract.

6.2 Disclaimer for AI content

All AI-generated content (summaries, perspectives, digest podcasts, answers from the "Ask the Video" function) is created automatically and may be incorrect, incomplete or outdated. It does not constitute advice and does not replace the user's own review of the original video. Videos with a duration of more than 4 hours as stated by YouTube are not newly summarized (see 4.1). For videos below this limit, the AI analysis may be limited to part of the video content for technical reasons; the summary then does not cover the entire video duration. See the separate Disclaimer (Haftungsausschluss).

7. Availability and changes

7.1 Availability

The Provider endeavors to provide availability that is as uninterrupted as possible. There is no entitlement to constant accessibility. Maintenance work, disruptions at third-party providers (YouTube, Supabase, transcript and AI service providers) or force majeure may lead to outages.

7.2 Changes to Quotas and Scope of Service

(1) The Provider may change the quotas and usage limits of the subscription tiers if there is a valid reason to do so. Valid reasons are: (a) changed prices or terms of the third-party services used; (b) technical changes to, or the discontinuation of, third-party services on which a feature depends; (c) reasons of security or prevention of abuse; (d) statutory or regulatory requirements.

(2) Changes in favour of users may be made at any time.

(3) Changes that impair use more than insignificantly will be announced by the Provider at least 6 weeks before they take effect, by e-mail or by notification in the app. The announcement states the content and the date of the change and refers to the right of termination.

(4) Such changes take effect no earlier than the billing period following the end of the notice period; for annual subscriptions, no earlier than the next renewal.

(5) The user may cancel the subscription in the App Store account settings at any time before the change takes effect. The Provider cannot itself refund fees already paid; Apple's terms apply to refunds.

(6) The Provider may offer additional subscription tiers and additional purchases. Switching is voluntary.

7.3 Changes to these Terms

The Provider reserves the right to change these Terms with reasonable notice. In the event of significant changes, existing users will be informed by email or in-app message. Changes to quotas and usage limits are governed exclusively by Section 7.2.

8. Termination and account deletion

The user may permanently delete their account at any time via the account deletion in the app settings (Settings → Delete account). All user-related data will be irreversibly removed (saved list, digests, settings, audio files, briefing rules); if a YouTube connection exists, the app revokes the YouTube authorisation granted to it with Google before deletion. The deletion does not affect data stored by YouTube itself.

Independently of account deletion, the user may disconnect the YouTube connection at any time in the app settings or revoke the authorisation via their Google security settings (https://security.google.com/settings/security/permissions).

The Provider may terminate the usage relationship without notice for good cause, in particular in the event of a breach of clause 3.

9. Data protection

Information on the processing of personal data can be found in the separate Privacy Policy at feedfocus.app/privacy.

10. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction for disputes with entrepreneurs is Lüneburg. For consumers, the statutory places of jurisdiction apply.

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
